This Privacy Policy applies to the Personal Data collected and processed by Pather when, YOU, as the user, interacts with Pather’s services, including when you interact with our websites, digital experiences, mobile apps, stores, online or offline events, promotions, or one of our other products or services, all of which are part of Pather’s “Platform” and direct to this Privacy Policy. By using Pather’s Platform, You agree to the collection and use of information in accordance with this Privacy Policy. 

 

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural format.

 

Definitions

For the purposes of this Privacy Policy:

 

  • Affiliate means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority;
  • Cookies are small files that are placed on Your computer, mobile device or any other device by a website, containing the details of the user’s browsing history on that website among its many uses;
  • Country refers to Canada, and (if applicable), the province of Ontario;
  • Device means any device that can access the Service such as a computer, a cellphone or a digital tablet;
  • Pather (also referred to as either "the Company", "We", "Us" or "Our") refers to Pather Plastics Canada Inc., located at 7400 Victoria Park, Markham, Ontario, L3R 2V4, and any and all of its affiliates, subsidiaries and groups under the “Pather” brand;
  • Personal Data (also referred to as “Personal Information”) refers to all the data referenced in the Personal Data section below;
  • Policy refers to this Privacy Policy;
  • Service refers to the Website;
  • Service Provider means any natural or legal person who processes the data on behalf of Pather. It refers to third-party companies or individuals employed by Pather to facilitate the Service, to provide the Service on behalf of Pather, to perform services related to the Service or to assist Pather in analyzing how the Service is used;
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (ex. the duration of a page visit);
  • Website refers to Site Web, accessible from www.pather.com;
  • You means the user of Pather Service, any individual or group of individuals accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable;
  • Your means the possessive adjective of You;

 

International Access 

This Policy is governed and construed in accordance with the privacy laws of Canada. Accessing the Service internationally may result in different laws applying, Pather encourages You to research and understand the laws surrounding privacy applicable to You. 

 

Personal Data

The definition of “personal information” depends on the applicable law of where You reside. For purposes of this Policy, “personal information” and/or “personal data” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to an individual or household.  This does not include aggregated or de-identified information that is maintained in a form that cannot reasonably be used to infer information about, or otherwise be linked to, a particular individual or household.

 

This includes: 

  • Identifiers. Pather collects certain personal information from You, such as your name, telephone number, email address, date of birth, password, and other identifiers, as well as any personal and demographic information that you share with us, such as gender, hometown, photos, and images You provide to us or post to Your profile, or product preferences. When You make a purchase, we collect Your payment or credit card information and shipping and billing address. 
  • Commercial Information. We collect information about Your purchases, favorites, and items that You view or add to Your cart.
  • Communications. When You communicate with us, we collect Your contact details and keep a record of the communications, as well as our responses. We also maintain records of information that You post on our social media channels, and information You provide to us related to any customer support requests.

 

Usage Data

Usage Data is collected automatically when using the Service. Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of the visit, the time spent on those pages, unique device identifiers and other diagnostic data.

 

When You access the Service by or through a mobile device, Pather may collect certain information automatically, including, but not limited to, the type of mobile device being used, the mobile device unique ID, the IP address, the mobile operating system, the type of mobile Internet browser being used, unique device identifiers and other diagnostic data.

 

We may also collect information that the browser sends whenever You visits our Service or when You accesses the Service by or through a mobile device.

 

Personal Data Use

The Company may use Personal Data for the following purposes:

  • Purchase and delivery of products and services. We use Your Personal Data to take and handle orders, deliver products and services, process payments, and communicate with You about orders, products and services, and promotional offers.

We use Your Personal Data to communicate with you in relation to news, special offers and general information about other goods, services and events which Pather offers that are similar to those that You have already purchased or enquired about unless You have opted not to receive such information.
  • To maintain the Service. We use Your Personal Data to ensure the Service is running without error.
  • For the performance of a contract. We use Your Personal Data for the development, compliance and undertaking of the purchase contract for the products, items or services You purchase, or of any other contract with Pather through the Service.
  • To manage client requests. We use Your Personal Data to attend and manage any requests made by You to Pather.
  • For business transfers. Pather may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Pather’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Pather about our Service users is among the assets transferred. 
  • Purposes for which we seek your consent. We may also ask for Your consent to process Your Personal Data for a specific purpose that we communicate to You.
  • For other purposes. We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, marketing and your experience.

 

If or when Pather transfers Personal Data outside of Your province or territory, or outside of Canada, Pather will make best efforts to ensure that the information is transferred in accordance with this Policy and as permitted by applicable laws on data protection.

 

Pather may but is not limited to sharing or disclosing Personal Data in the following situations:

  • With Service Providers: to monitor and analyze the use of our Service, to contact You.
  • For business transfers: in connection with, or during negotiations of, any merger, sale of Pather assets, financing, or acquisition of all or a portion of Pather to another company.
  • With Affiliates or Subsidiaries: any information shared with affiliates or subsidiaries, in which case we will require such entities to honor this Privacy Policy. This may also include joint venture partners or other companies that Pather controls or that are under common control with Pather.
  • With business partners:  to offer You certain products, services or promotions.
  • With other users: when You share Personal Data or otherwise interact in the public areas with other users, such information may be viewed by all users and may be publicly distributed outside.
  • Protection Purposes. Pather may disclose any and all Personal Data collected when we believe disclosing is appropriate to comply with the law; enforce or apply our Conditions of Use and other agreements; or protect the rights, property, or safety of Pather, our users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction. 
  • With Your consent: Pather may disclose the Your personal information for any other purpose with Your consent.

 

Retention of Personal Data

Pather will retain Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. Pather will retain and use Personal Data to the extent necessary to comply with our legal obligations, comply with any and all laws, resolve disputes, and enforce our legal agreements and policies.

 

Pather will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Pather Service, or Pather are legally obligated to retain this data for longer time periods.

 

Transfer of Personal Data

Your information, including Personal Data, is processed at Pather’s operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of the province, territory, state, country or other governmental jurisdiction where the data protection laws may differ than those from Your jurisdiction.

 

Your consent to this Privacy Policy followed by Your submission of such information represents the Your agreement to that transfer.

 

Pather will take all steps reasonably necessary to ensure that Your Personal data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of Your Personal Data and other information.

 

Deletion of Personal Data

You have the right to delete or request that Pather assists in deleting the Personal Data that Pather has collected about You.

 

You may also contact Pather to request access to, correct, or delete any Personal Data that the You have provided to Pather.

 

Please note, however, that Pather may need to retain certain information when Pather have a legal obligation or lawful basis to do so.

 

Security of Personal Data

The security of Personal Data is important to Pather, but no method of transmission over the Internet, or method of electronic storage is 100% secure. While Pather strives to use commercially acceptable means to protect Personal Data, Pather cannot guarantee its absolute security. 

 

Children's Privacy

Our Service does not address anyone under the age of 13. Pather does not knowingly collect personally identifiable information from anyone under the age of 13. If You are a parent or guardian and becomes aware that the Your child has provided Pather with Personal Data, please contact Pather. If Pather becomes aware that Pather has collected Personal Data from anyone under the age of 13 without verification of parental consent, Pather will take steps to remove that information from its servers.

 

If Pather needs to rely on consent as a legal basis for processing the Your Personal Data and the Your jurisdiction requires consent from a parent, Pather may require Your or Your parent’s (if applicable) consent before Pather collects and/or uses that information.

Pather Service may contain links to other websites that are not operated by Pather. If You click on a third party link, You will be directed to that third party's site. Pather strongly advises You to review the Privacy Policy of every site You visit.

 

Pather has no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

 

Tracking Technologies and Cookies

We use Cookies and similar tracking technologies to track the activity on Pather’s Service and store certain information. Tracking technologies used are beacons, tags, and scripts to collect and track information and to improve and analyze Pather Service. The technologies Pather uses may include:
